By booking, purchasing, or otherwise engaging Spellbinding Design for services, you acknowledge that you have reviewed and agree to the policies outlined on this page.These policies apply to services provided by Spellbinding Design unless different terms have been agreed upon in writing for a specific project or service.Because every project is different, individual quotes, invoices, proposals, emails, or other written agreements may contain additional terms specific to your project. When project-specific written terms differ from these general policies, the project-specific terms will apply.Spellbinding Design reserves the right to update these policies as services, business practices, licensing requirements, and industry standards evolve. The policies applicable to an active project will be those in effect when the project was booked unless otherwise agreed upon in writing.

Payment for your project gives you the right to use the completed design for the intended purpose outlined in your project agreement. It does not automatically transfer ownership or copyright of every element used to create the design.A completed design may include original creative work produced by Spellbinding Design as well as third-party materials such as stock photography, illustrations, fonts, textures, or other licensed assets. Each of these elements may be subject to separate ownership and licensing terms.Spellbinding Design retains ownership of its original creative work unless additional rights are specifically transferred through a written agreement. Third-party materials remain the property of their respective copyright holders and are subject to their individual licensing terms.Your license allows you to use the completed design for its intended purpose, such as your book cover and associated promotional materials. It does not automatically give you the right to sell, transfer, sublicense, modify, or grant the artwork to another company for a separate commercial use.If a publisher, audiobook company, production company, foreign publisher, or other third party would like to reuse or adapt the artwork, please contact Spellbinding Design. Additional design rights can be licensed separately when available, and any necessary third-party asset licenses must also be obtained.Layered PSD files, working files, original stock files, and other source materials are not included in standard project delivery and are not transferred as part of the completed design.

The license provided with your design is granted specifically to you for the intended use outlined in your project agreement. This license does not automatically extend to publishers, audiobook companies, production companies, distributors, or other third parties wishing to reuse, modify, reproduce, or adapt the artwork for a separate product, edition, or commercial purpose.If a third party would like to reuse an existing Spellbinding Design cover or artwork, including for audiobooks, special editions, foreign editions, merchandise, adaptations, or other commercial uses, they must contact Spellbinding Design directly to obtain the appropriate design license.Any third-party materials incorporated into the design, including stock photography, illustrations, fonts, textures, or other licensed assets, remain subject to the licensing terms of their respective copyright holders. Spellbinding Design can only license the original creative work and rights it owns and cannot transfer or grant rights to third-party materials. The requesting party may therefore be required to obtain its own licenses for those assets.Layered PSD files, working files, original stock files, and other source materials are not included in standard project delivery and are not automatically transferred with the completed design. Source files and expanded usage rights may be licensed separately when available.

Yes. Any stock image selected for your final design must be purchased and licensed by you directly through the stock provider.Spellbinding Design maintains its own stock subscriptions for sourcing, downloading, and creating your design. Those accounts and licenses belong to Spellbinding Design and cannot be transferred or shared with clients.Once the final image or images are selected, I will provide you with the appropriate links so you can purchase them through your own account. This gives you your own license and record of purchase for the stock imagery incorporated into your design.Stock licensing is separate from your design fee. Your design fee covers the creative work performed by Spellbinding Design, including concept development, composition, typography, image manipulation, color work, effects, and preparation of your final files.Purchasing a stock image does not give you ownership of the original photograph or artwork, nor does it transfer ownership of Spellbinding Design's original creative work or source files.If you later want to use the artwork for something beyond its original purpose, such as merchandise, special products, or licensing the artwork to another company, additional permissions or licensing may be required. Please contact Spellbinding Design before expanding its use.

No. Standard project delivery includes the completed files necessary for the intended use of your design. Layered PSD files, working files, original stock files, and other source materials are not included.Source files contain Spellbinding Design's original working materials and may also contain third-party assets that cannot be transferred under their original licenses. When available and appropriate, source files or additional design assets may be licensed separately. Additional fees and licensing requirements may apply.

Your completed design is delivered as a finished product and is intended to be used as provided. If you need changes after final delivery, Spellbinding Design can make those changes for you.Layered PSD and other working/source files are not included with standard design services but may be licensed separately when available. If you purchase a source file license, you may modify the design yourself or provide the file to another designer for modification.Once the design has been modified by you or another party, the modified version may no longer be represented or credited as an original Spellbinding Design creation. Spellbinding Design is not responsible for modifications, errors, print or production issues, or other changes made to the artwork after the editable files have been delivered.Purchasing a source file license does not transfer ownership or licensing rights to third-party materials incorporated into the design. This may include stock photography, illustrations, fonts, textures, or other licensed assets. You are responsible for obtaining and maintaining the appropriate licenses for any third-party materials you continue to use.Spellbinding Design will provide information regarding applicable third-party assets when necessary so that you can obtain the appropriate licenses.Your source file license applies to the original creative work produced by Spellbinding Design and gives you the flexibility to continue working with the design without requiring all future modifications to be completed by Spellbinding Design.

Yes. You are welcome to provide your own photographs, stock images, illustrations, fonts, logos, artwork, or other materials for use in your project.By providing materials to Spellbinding Design, you confirm that you own the materials or have obtained the appropriate license, permission, or authorization to use them for the intended project. You are responsible for ensuring that any materials you provide do not infringe upon another person's copyright, trademark, publicity rights, or other intellectual property rights.If you provide licensed stock photography or other third-party assets, please retain your original purchase and licensing information. Spellbinding Design may request proof of licensing when necessary.Spellbinding Design reserves the right to decline any client-provided material if its ownership, source, or licensing cannot reasonably be verified.Spellbinding Design is not responsible for copyright, licensing, or usage violations resulting from materials supplied by the client when the client represented that they had the necessary rights or permissions to use them.If you're unsure whether you have the appropriate rights to an image or asset, please ask before we incorporate it into your design.

Your completed design includes the files and services specified in the package or project you originally purchased. A standard design package does not include preparation of artwork for additional formats, editions, products, or applications.If you later need your design adapted or prepared for a special edition, audiobook, foreign edition, collector's edition, merchandise, subscription box, promotional product, or another format, additional design and production fees will apply.For example, special-edition production may require additional artwork, formatting, full-wrap adjustments, case laminate design, foil or spot layers, sprayed or printed edges, endpapers, interior elements, or other print-specific files. These services are not included with a standard cover design and may require the purchase of a Special Edition package or additional design services.Additional uses may also require expanded licensing. Stock photography, illustrations, fonts, textures, and other third-party assets remain subject to their respective licensing terms, and certain uses may require additional or extended licenses.Spellbinding Design can only grant rights to the original creative work it owns and cannot grant or transfer rights belonging to photographers, illustrators, stock providers, font creators, or other third parties.If you'd like to expand an existing design into another format or product, please contact Spellbinding Design for a quote. I can review the project, determine what additional design work is required, and identify any licensing considerations before production begins.

Yes. Spellbinding Design reserves the right to display completed design work as part of its professional portfolio and for promotional purposes. This may include the Spellbinding Design website, social media, advertisements, marketing materials, design showcases, professional presentations, speaking engagements, educational examples, and other promotional uses.For books and other projects that have not yet been publicly announced, Spellbinding Design will respect scheduled cover reveals, release announcements, publication dates, or other agreed-upon embargo dates. Your design will not be intentionally revealed publicly by Spellbinding Design before the agreed date.Once a project has been publicly revealed or released, Spellbinding Design may identify the work as a Spellbinding Design creation and share it as an example of completed client work.If a design has been modified by the client or another party after delivery, Spellbinding Design reserves the right not to display or claim the modified version as its original work.

Completed project files are delivered through a Dropbox folder provided by Spellbinding Design. Once your project has been completed and delivered, it is your responsibility to download and securely save all final files included with your purchase.Spellbinding Design will temporarily maintain delivered files as a courtesy but does not provide permanent file storage or archival services. Dropbox folders and project files may be removed after a period of time without notice, so please do not rely on your delivery folder as permanent storage.Layered PSD files, working files, and other source files are not permanently archived and are not included with standard project delivery. If you would like the layered PSD/source file for your project, it must be purchased while the file is still available.Spellbinding Design cannot guarantee that a PSD or other working file can be recovered or recreated after a project has been completed and archived or removed.If you purchase a PSD/source file, you are responsible for downloading and maintaining your own copy along with the appropriate licenses for any stock photography, fonts, illustrations, or other third-party assets contained within the design.Requests to retrieve, recreate, rebuild, reformat, or prepare previously delivered artwork may be subject to additional fees.

Revisions included with your project are limited to the number and scope specified in the package or service you purchased. Revisions are intended to refine the approved design concept and do not include entirely new concepts, changes in creative direction, or additional services and deliverables.Once a design has been approved and finalized, any additional changes are considered new work and may require an additional fee.Changes made after final approval, including changes to the title, author name, subtitle, trim size, page count, printer specifications, edition, format, or other information previously approved by the client, may also require an additional fee.If a printer or publishing platform requires a technical adjustment to a file Spellbinding Design prepared according to the original specifications provided, please contact me so I can review the issue. Technical corrections related to an error in the original file will be corrected when applicable. Changes resulting from new specifications, a different printer or platform, updated information, or changes to the project are considered additional work.If the requested changes fall outside the scope of your original package, Spellbinding Design will provide pricing before completing the additional work.

Before final files are delivered, you are responsible for carefully reviewing and approving all artwork, text, and information included in your design.This includes, but is not limited to, the author name, title, subtitle, series information, book description, endorsements, ISBN, barcode information, pricing, website addresses, social media information, spelling, punctuation, and any other client-provided content.Spellbinding Design will make every reasonable effort to identify obvious errors during the design process, but design services do not include professional proofreading or copyediting unless specifically included in your project.Your final approval confirms that you have reviewed the design and that the information provided is correct and ready for production or publication.If an error is discovered after final approval and delivery, Spellbinding Design can make the necessary correction when possible. Additional fees may apply when the error was contained in client-provided information or was approved by the client before final delivery.If an error was introduced by Spellbinding Design and does not match the information originally provided and approved by the client, it will be corrected at no additional charge.

Spellbinding Design schedules projects in dedicated creative blocks, with consultation, research, planning, and preparation often taking place before your scheduled design time.To keep projects on schedule, all requested information and materials must be provided by the agreed deadline. This may include manuscripts or summaries, questionnaires, cover specifications, inspiration, logos, photographs, back-cover copy, ISBN information, printer templates, or other materials needed for your project.If required materials are not received in time, your project may need to be rescheduled to the next available opening. Availability cannot be guaranteed within the original timeframe once a scheduled project has been postponed.If something comes up, please communicate with me as soon as possible. I understand that publishing schedules change, manuscripts run late, page counts move, and life happens. When possible, I will work with you to reschedule your project.Significant delays, repeated rescheduling, or projects left inactive for an extended period may require a new scheduling date and/or additional fees, particularly when consultation, research, specifications, or previously completed work must be revisited.Spellbinding Design is not responsible for missed publication, preorder, cover reveal, printing, or marketing deadlines resulting from delayed materials, approvals, responses, or other information required from the client.

Not always. Digital screens and physical printing reproduce color differently. Screens display color using RGB light, while most commercial printing uses CMYK inks or other print processes. Differences in monitors, screen brightness, paper stock, finishes, printing equipment, ink, and individual print providers can all affect the final appearance of a printed design.Spellbinding Design prepares print files according to the specifications provided by your selected printer or publishing platform and follows appropriate prepress and color preparation standards for the intended production method.Because the physical printing process is performed by a third party, Spellbinding Design cannot guarantee an exact color match between what you see on your screen and the finished printed product.When color accuracy is especially important, clients are strongly encouraged to order a physical proof before approving a full print run.If a printer identifies a technical issue with a file prepared by Spellbinding Design, please send me the printer's specifications or requested corrections so I can review them. If the issue resulted from an error in the file I prepared, I will correct it at no additional charge.Changes required because you changed printers, trim size, binding, paper, page count, production method, printer specifications, or other project requirements after the original files were completed are considered additional production work and may require an additional fee.

Rush services may be available depending on my current schedule and the scope of your project. Because Spellbinding Design schedules dedicated creative time for each client, rush projects must be approved before booking and may require an additional rush fee.If your project has a firm deadline, including a cover reveal, preorder, publication date, print deadline, advertising campaign, or event, please provide that information when booking.Spellbinding Design will make every reasonable effort to meet agreed-upon deadlines. However, turnaround times depend on timely communication, approvals, and delivery of all required materials from the client.Rush service does not eliminate the client's responsibility to provide complete and accurate information, respond to questions, review proofs, and provide approvals within the necessary timeframe.Spellbinding Design is not responsible for delays caused by late client materials or approvals, changes to the original project scope, third-party vendors, printers, publishing platforms, stock providers, technical outages, shipping or manufacturing delays, or other circumstances outside of Spellbinding Design's control.If additional work or substantial changes are requested during a rush project, the original deadline may need to be adjusted and additional fees may apply.

Your project price is based on the services, deliverables, and scope agreed upon at the time of booking. I understand that publishing projects evolve, and sometimes plans change along the way.If you request work that falls outside of the original project scope, additional fees may apply. This may include additional formats, new concepts, additional marketing materials, significant design changes, new editions, additional books in a series, special-edition elements, or other deliverables that were not included in your original package.Changes to information or specifications originally provided by the client, including trim size, page count, binding type, printer, publishing platform, title, subtitle, author name, or production requirements, may also result in additional work and fees.If the scope of your project changes, Spellbinding Design will let you know before completing any additional billable work so there are no surprise charges.Whenever possible, additional services can simply be added to your existing project rather than requiring you to start over.

Yes. Spellbinding Design understands that many projects involve confidential or unreleased information, including manuscripts, book titles, cover artwork, series details, pen names, release plans, marketing strategies, and other materials that may not yet be public.Information and materials provided for your project will be used for the purpose of completing your contracted services and will not be intentionally shared publicly before your approved announcement, cover reveal, or release date.If your project has a specific embargo, cover reveal, or announcement date, please provide that information when booking or as soon as the date is established.Once the project has been publicly announced or released by you, your publisher, or another authorized party, Spellbinding Design may display the completed work in its portfolio, website, social media, professional presentations, or other promotional materials.If your project requires additional confidentiality beyond this standard policy, please let me know before work begins so any specific requirements can be discussed.

No. Spellbinding Design does not use AI-generated artwork in its designs. Stock photography, illustrations, and other visual assets are specifically selected to exclude content identified as AI-generated whenever that information is available through the asset provider.If a client chooses to provide AI-generated or AI-assisted artwork for inclusion in their project, the client must disclose that the material is AI-generated and assumes responsibility for choosing to use it.Client-provided AI-generated materials are treated as client-supplied assets. The client is responsible for confirming that they have the appropriate rights and permissions for their intended commercial use and for complying with any applicable publishing platform, retailer, distributor, or other third-party requirements regarding AI-generated content.Spellbinding Design cannot guarantee the copyright eligibility, originality, exclusivity, ownership, or legal status of AI-generated materials supplied by a client and assumes no responsibility for claims or restrictions arising from the client's decision to use those materials.Spellbinding Design will not replace traditionally created or properly licensed artwork with AI-generated imagery without the client's knowledge. Any AI-generated imagery appearing in a Spellbinding Design project will have been knowingly supplied or specifically requested by the client.

Yes. Designer credit is requested whenever design credits are included in your book, copyright page, website, retailer information, promotional materials, or other publication details.Please credit the designer as:Cover Design by Laura HidalgoFor projects other than book covers:Design by Laura HidalgoIf a publisher, audiobook company, production company, or other third party licenses the artwork, designer credit should also be given to Laura Hidalgo where design credits are provided.If the original design is substantially modified by the client or another designer after the layered PSD/source file has been purchased, the modified version should no longer be credited as an original Laura Hidalgo design.

To keep project details organized and ensure important information is not missed, all project-related communication, approvals, changes, and file submissions should be sent through the agreed-upon communication method for your project.Please do not rely on social media comments, direct messages, text messages, or other informal communication for important project changes or final approvals unless we have specifically agreed to communicate that way.Clients are responsible for providing a current email address and monitoring project communications while their project is active.When multiple people are involved in a project, such as an author, publisher, assistant, publicist, or co-author, please designate one primary contact whenever possible. Conflicting instructions from multiple parties can delay the project, and Spellbinding Design may pause work until a final direction is confirmed.Any approval provided by the client or their designated representative will be considered authorization to proceed with the project.

Spellbinding Design may prepare files for or work alongside third-party companies and services, including printers, publishers, publishing platforms, web hosts, domain providers, stock providers, email marketing platforms, social media platforms, and other vendors selected for your project.While I will make every reasonable effort to prepare and provide materials according to the specifications available at the time of your project, Spellbinding Design does not control the operation, policies, pricing, availability, production quality, processing times, technical requirements, or service changes of third-party companies.Spellbinding Design is not responsible for outages, platform changes, discontinued services, printing or manufacturing issues, shipping delays, account restrictions, vendor errors, changes in pricing, or other circumstances caused by a third-party provider.If a third party changes its specifications or requirements after your project has been completed, any work required to update, reformat, rebuild, or resubmit your files may be considered an additional service and may require an additional fee.If an issue is caused by an error in a file originally prepared by Spellbinding Design, I will review the issue and correct my work when applicable at no additional charge.

Whenever possible, domains, website hosting, email marketing services, social media accounts, publishing accounts, and other third-party services required for your project should be established in the client's name and under the client's own account.Clients are responsible for maintaining their accounts, subscriptions, payment information, passwords, renewals, domains, hosting plans, and other third-party services after project completion.If Spellbinding Design assists with setting up, configuring, or managing a third-party account, that assistance does not make Spellbinding Design the owner of the account or responsible for its ongoing fees, renewals, security, availability, or maintenance unless ongoing management is specifically included in your service agreement.Premium themes, plugins, applications, hosting, domains, email services, platform subscriptions, or other third-party expenses are not included in design fees unless specifically stated in your package or proposal.If ongoing website maintenance or account management is needed after your project is completed, those services may be purchased separately when available.

Your purchase includes only the final design or concept you select as part of your purchased package.Any concepts, drafts, alternate designs, or other creative work presented during the design process that you do not select or purchase remain the property of Laura Hidalgo and Spellbinding Design.Unselected designs may be modified, repurposed, and offered for sale as premade designs to other clients. Elements specific to your project, including your title, author name, proprietary materials, or other identifying information, will be removed or replaced before the design is offered for sale.Unselected concepts may not be copied, recreated, modified, shared with another designer for recreation, or used by the client unless they are separately purchased from Spellbinding Design.If you would like to keep an additional concept from being offered as a premade design, you may purchase that concept before your project is closed. Additional fees will apply.

Every Spellbinding Design project involves work beyond the final artwork you receive. Depending on the service, this may include consultation, project planning, market and genre research, visual research, concept development, stock sourcing, creative direction, and dedicated design time.Design projects are scheduled in focused 2–3 hour creative blocks specifically reserved for your project. This allows me to concentrate on your design without dividing that time between multiple clients.Because work begins before the actual design is created, payments are non-refundable once the project process has begun. This includes consultation, research, preparation, concept development, stock sourcing, and other work completed in preparation for your scheduled design time.If you need to postpone or reschedule before your scheduled design block, please contact Spellbinding Design as soon as possible. When possible, your project may be moved to another available date rather than canceled.Once your scheduled design work has begun, payments are non-refundable. If you choose to discontinue the project, unfinished concepts, drafts, working files, and other materials created by Spellbinding Design may not be used, reproduced, modified, or provided to another designer unless otherwise agreed upon in writing.Any additional services, consultations, or third-party expenses already completed or purchased for the project are also non-refundable.If Spellbinding Design is unable to complete your project, I will work with you to determine an appropriate resolution based on the circumstances and the work already completed.

Retainer and contracted services are offered in fixed terms of 3, 6, 9, or 12 months.3-Month Agreements:Three-month agreements are a fixed minimum commitment and remain in effect through the contracted end date. If you would like to continue services beyond the original three-month term, please provide written notice before the contract expires so availability and a new service term can be confirmed.Three-month agreements do not automatically renew unless otherwise stated in your individual agreement. Continued availability after the contract ends is not guaranteed.6, 9 & 12-Month Agreements:Cancellation or non-renewal of a 6, 9, or 12-month agreement requires a minimum of 60 days' written notice. The client remains responsible for scheduled payments and contractual obligations during the notice period.Cancellation does not eliminate outstanding balances, previously approved expenses, completed work, or other financial obligations incurred under the agreement.Retainer payments are made in exchange for reserved availability and the services provided under the agreement. Unused time, services, or deliverables do not automatically qualify for a refund or rollover unless specifically stated in your individual agreement.If you would like to extend or renew your agreement, please contact Spellbinding Design before your current term expires. Renewal is subject to availability, current pricing, and the services agreed upon for the new term.If your individual contract contains different renewal, cancellation, or termination terms, the terms of that agreement will take precedence over this general policy.

Final, unwatermarked files are delivered once the project has been completed, approved, and all outstanding balances associated with the project have been paid in full.Drafts, proofs, concepts, mockups, and other materials provided during the design process are for review and approval only. They may not be published, reproduced, distributed, altered, or commercially used before final payment unless otherwise agreed to in writing.Payment must be completed before final production files are released. Any additional services or charges approved during the project must also be paid before the applicable files are delivered.Once payment has been completed, you receive the final deliverables and usage rights included with the package or services you purchased. Payment does not automatically include layered PSD/source files, expanded licensing, additional formats or editions, or ownership of third-party assets unless specifically included in your agreement.Unpaid or partially paid work remains the property of Laura Hidalgo and Spellbinding Design and may not be used until the outstanding balance has been resolved.

Spellbinding Design is committed to maintaining a professional, respectful, and collaborative working environment. The same courtesy and professionalism extended to clients is expected in return.Harassment, threats, intimidation, discrimination, abusive or excessively hostile communication, personal attacks, repeated boundary violations, or other inappropriate behavior toward Laura Hidalgo, Spellbinding Design, contractors, collaborators, or others involved in a project will not be tolerated.Spellbinding Design reserves the right to decline, pause, or terminate services when a client's conduct makes it unreasonable, unsafe, or professionally inappropriate to continue the working relationship.Spellbinding Design also reserves the right to refuse requests involving unlawful activity, infringement of another person's rights, fraud, hate or discriminatory content, or other work that could reasonably create legal, ethical, safety, or professional concerns.If a project is terminated because of client misconduct or violation of these policies, payments for work already completed, consultation, research, preparation, scheduled design time, and other services already performed are non-refundable. Any remaining financial or project obligations will be handled according to the original agreement and applicable policies.Termination of services does not authorize the use of unpaid drafts, concepts, proofs, working files, or other materials that have not been purchased and delivered as final work.Spellbinding Design may also decline future projects or discontinue an ongoing professional relationship at its discretion when previous conduct has demonstrated that the working relationship is no longer a suitable fit.

No. Providing creative services to a client does not constitute an endorsement of the client, their personal conduct, business practices, publications, opinions, or actions.Spellbinding Design is also not responsible for the conduct, reputation, actions, or future circumstances of models, photographers, illustrators, narrators, publishers, vendors, influencers, or other individuals or companies associated with a project.Spellbinding Design cannot predict or control events that occur after a project is created. This includes public controversies, allegations of misconduct, industry blacklisting, platform suspensions or removals, criminal or civil matters, contractual disputes, changes in professional relationships, or other circumstances involving a client or third party.If circumstances arise that cause a client, model, contributor, company, or other person associated with a project to become unsuitable for continued association with Spellbinding Design, I reserve the right to remove the project from my portfolio, website, social media, or promotional materials without affecting the client's existing rights to use the completed design under their original agreement.Spellbinding Design also reserves the right to decline, suspend, or terminate services when continued work would involve unlawful activity, harassment, abusive or threatening behavior, fraud, infringement of another person's rights, hate or discriminatory conduct, or circumstances that could reasonably harm Spellbinding Design, its clients, or its professional reputation.If a completed design must later be changed because of circumstances involving the client or a third party, including replacing a model, photograph, endorsement, name, logo, or other element, the redesign or replacement work is considered a new service and additional fees will apply.

While every effort is made to complete projects according to the agreed schedule, occasionally circumstances outside of either party's reasonable control may cause unexpected delays.These circumstances may include illness or medical emergencies, family emergencies, natural disasters, severe weather, power or internet outages, equipment failure, widespread technical or platform outages, government actions, or other events that could not reasonably have been anticipated or prevented.If an unexpected circumstance affects Spellbinding Design's ability to complete your project as scheduled, I will communicate with you as soon as reasonably possible and work to establish a revised timeline.Likewise, clients will not be penalized for reasonable delays caused by genuine emergencies or circumstances outside of their control. Please communicate with me as soon as possible so we can determine how best to reschedule or continue the project.Neither party will be considered responsible for failing to meet a deadline when the delay is directly caused by circumstances reasonably outside of their control. This does not eliminate payment obligations for work or services already completed.
